These Terms & Conditions (“Terms”) govern your purchase and use of website design and setup services provided by The Practice Refined (“we,” “us,” or “our”).
By purchasing our services, you (“you” or “client”) agree to these Terms.
1. Our Services
The Practice Refined provides professionally designed website templates, website customization, website setup, and related digital services for therapists, counsellors, and other private-practice professionals.
The specific services included in your purchase will depend on the package you select.
Each package has defined limits regarding pages, revisions, features, and customization. Work outside the included scope may be subject to additional fees.
2. Website Templates
Our website designs are created as starting points for individual practices.
Template designs may be customized with your practice information, branding, photographs, colours, services, and other agreed-upon content.
The underlying template design, layout, systems, and design concepts remain the intellectual property of The Practice Refined unless otherwise agreed in writing.
You receive permission to use the completed website for your own practice. You may not resell, redistribute, reproduce, or provide our templates to another person or business as a template or website product.
3. Client Responsibilities
To complete your website, you are responsible for providing accurate and timely information, including where applicable:
Business and practice name
Professional biography
Credentials and registration information
Services and descriptions
Contact information
Photographs and other images
Social media links
Booking links
Legal and regulatory information required for your practice
You are responsible for ensuring that all information you provide is accurate and appropriate for publication.
You are also responsible for ensuring that your website content complies with the professional, regulatory, advertising, privacy, and other legal requirements applicable to your profession and jurisdiction.
The Practice Refined does not provide legal, regulatory, clinical, or professional-practice advice.
4. Client Content
You confirm that you have the right to provide and use any text, photographs, logos, graphics, or other materials supplied to us.
You are responsible for obtaining appropriate permission or licensing for materials you provide.
You agree not to provide confidential patient, client, or protected health information through our project forms, email, or other communication channels unless specifically agreed and appropriately secured.
5. Revisions
Each package includes the number of revision rounds specified in the package description.
A revision round consists of a consolidated list of reasonable changes to the existing website.
Requests for additional revisions, substantial redesigns, additional pages, new functionality, or work outside the original scope may be charged separately.
Additional work will be discussed with you before the additional charges are incurred.
6. Project Timeline
We will provide an estimated project timeline after receiving the information and materials required to begin.
Project timelines may be affected by delays in receiving content, images, feedback, approvals, or other information from the client.
We are not responsible for delays caused by circumstances outside our reasonable control.
7. Approval and Launch
Before launch, you are responsible for reviewing the website and confirming that the content, links, contact information, images, and other details are accurate.
Once you approve the website and it is launched, you remain responsible for reviewing your website periodically and notifying us of any errors or changes required.
8. Hosting and Domain Names
Unless specifically included in your package, website hosting and domain registration are separate services.
We recommend that clients maintain ownership of their own domain and hosting accounts.
The Practice Refined is not responsible for domain expiration, hosting interruptions, third-party service outages, or fees charged by hosting or domain providers.
9. Third-Party Services
Your website may use third-party services such as hosting providers, booking platforms, payment processors, analytics services, email platforms, plugins, or other software.
Third-party services are governed by their own terms and policies.
We are not responsible for changes, outages, pricing, functionality, security, or availability of third-party services.
Where a paid third-party service is required, the client is responsible for the applicable subscription or renewal fees unless otherwise agreed.
10. Website Maintenance
Website maintenance is not automatically included after the project has been completed unless you have purchased an ongoing maintenance or care plan.
If you purchase an ongoing care plan, the services included will be those specified in your selected plan.
New pages, redesigns, major content changes, and functionality outside the care plan may incur additional fees.
11. Payment
Payment is required according to the payment terms presented at the time of purchase.
Work will not begin until the required payment has been received.
For projects requiring additional work outside the original scope, additional payment may be required before that work begins.
12. Cancellation and Refunds
Cancellation and refund requests are governed by our Cancellation & Refund Policy, which forms part of these Terms.
Once work has begun, payments relating to work already performed are generally non-refundable.
13. Intellectual Property
The Practice Refined retains ownership of its original templates, design systems, graphics, layouts, written materials, code, and other proprietary materials created for use across our services.
After full payment, the client receives the agreed rights to use the completed website for their own practice.
Client-provided content, including the client's logo, photographs, written content, and other materials, remains the property of the client or its respective owner.
We may display completed websites or screenshots of our work in our portfolio, website, social media, or promotional materials unless the client requests otherwise in writing.
14. Professional and Regulatory Compliance
The Practice Refined provides website design and setup services and does not determine whether a client's website complies with the laws, professional standards, advertising requirements, registration requirements, or regulatory rules applicable to their profession.
The client is responsible for reviewing and approving their website content before publication and ensuring that it complies with the requirements applicable to their practice.
15. Privacy
Information collected through our website and during the provision of our services is handled according to our Privacy Policy.
Clients should not submit confidential patient or client information through ordinary website inquiry forms or project communications.
16. Limitation of Liability
To the extent permitted by applicable law, The Practice Refined will not be responsible for indirect, incidental, special, or consequential losses arising from the use of a website or third-party service.
We do not guarantee specific search-engine rankings, website traffic, client inquiries, bookings, revenue, or other business results from a website.
Our services are provided based on the information and instructions supplied by the client.
Nothing in these Terms is intended to exclude or limit liability where doing so would be prohibited by applicable law.
17. Changes to Services
We may update our service offerings, packages, pricing, or processes from time to time.
Changes will not affect services that have already been purchased unless otherwise agreed with the client.
18. Termination
We may suspend or terminate a project if a client fails to provide required information, fails to make required payments, requests unlawful or inappropriate content, or otherwise materially breaches these Terms.
If a project is terminated, amounts already paid for work completed or services provided may remain non-refundable.
19. Governing Law
These Terms are governed by the laws applicable in the jurisdiction where The Practice Refined operates, unless otherwise required by applicable law.
